Horses can be shipped out following the conclusion of the sale and must be removed no later than September 19 at 12:00 pm. Horses not removed by then will be subject to fees.
Payment Details:
Payment is advised within 30 minutes of sale session on sale day at the Sales Office. All accounts must be paid in full in Canadian funds within 15 banking days from the date of sale (see Conditions of Sale).

The Society reserves the right to charge interest on any outstanding balance at the rate of 2% per month (24% per annum) until payment is received in full

CONDITIONS OF SALE
IMPORTANT NOTICES – PLEASE READ
This sale is governed by these Conditions of Sale and all announcements from the auctioneer’s stand or otherwise (“Announcements”). All sellers, prospective bidders/buyers, all other interested parties, and all sales are bound by and subject to the provisions of the Conditions of Sale as set forth in this catalogue and Announcements.
All prospective bidders are urged to carefully examine horses in which they may be interested personally and/or by agents or veterinarians of their choosing before bidding, as they are accepting any horse purchased with all conditions and defects except those specifically warranted in these Conditions of Sale and not so announced prior to sale.
Consignors may make arrangements with prospective bidders/buyers prior to sale which differ from these Conditions. In such events C.T.H.S. (Alberta Division) (herein known as the “CTHS”) shall have no responsibility in regard to any such agreements, and the enforcement thereof shall be the responsibility of the parties to the agreement.
FIRST – APPLICABLE LAW; LIMITATION OF WARRANTIES
The horses included herein are offered for sale according to the laws of the Province of Alberta. The right to bid in this sale is reserved for all sellers, including their disclosed and undisclosed agents, unless otherwise announced at time of sale.
THERE IS NO WARRANTY EXPRESSED OR IMPLIED BY CTHS OR CONSIGNOR (INCLUDING OWNER) EXCEPT AS SET FORTH HEREIN, AS TO THE MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE OF ANY HORSE OFFERED IN THIS SALE. ALL SALES ARE MADE ON AN “AS IS” BASIS WITH ALL FAULTS AND DEFECTS.
SECOND – RESOLUTION OF BIDDING DISPUTES
Should any dispute arise between or among two or more bidders, CTHS shall forthwith adjudicate the dispute, and its decision shall be absolute, final, and binding on all parties.
Bids received after the fall of the hammer are not grounds for dispute.
Bids acknowledged by bid spotters employed by CTHS are recognized as if tendered to CTHS.
In case of dispute, the bidding shall be reopened for advance bids; if there is no advance, the horse is sold to the person from whom CTHS recognized the last bid.
In case of dispute, advance bidding shall be restricted to the contending parties, but should the recognized bid be reduced below the bid at commencement of dispute, then the bidding is reopened to all bidders, regardless of whether or not final bid exceeds bid which was disputed.
CTHS reserves the right to reject any or all bids. In the event that the consignor (or his agent) bids in his own horse, CTHS shall be so notified within thirty (30) minutes of conclusion of that sales session.
THIRD – PASSING OF TITLE; DELIVERY
Title passes to the purchaser at the fall of the auctioneer’s hammer, at which time purchaser shall be responsible for the care, custody, control, and security of the horse and for all expenses relating thereto.
The sale is for cash (unless credit has been established).
Purchaser shall sign the Acknowledgement of Purchase form forthwith.
All risk of injury becomes purchaser’s risk at passing of title.
Purchaser agrees to release, defend, indemnify and hold CTHS, and the owners/operators of the facilities and their representatives, harmless from all losses, damages, expenses, claims, or legal fees arising out of the possession, care, custody, or maintenance of any horse purchased.
Horses will be held for purchaser by consignor until settlement is made as provided in Condition Fourth. Purchaser must present himself for settlement within thirty (30) minutes of conclusion of the sales session. Upon settlement, a “stable release” will be issued, which must be presented to remove the horse from the premises.
FOURTH – TERMS FOR SETTLEMENT; REMEDIES UPON DEFAULT
Purchaser shall make settlement with the cashier in all cases. Unless CTHS extends credit, settlement must be made within thirty (30) minutes of the fall of the hammer in the form of Canadian currency, approved bank cheque, or certified cheque.
CTHS reserves the right to:
Refuse to extend credit to purchasers with unpaid accounts.
Refuse to accept bids from purchasers without satisfactory credit.
Require collected funds or an irrevocable Letter of Credit prior to accepting any bid(s).
Purchasers with approved credit grant CTHS a Security Interest in all horses purchased and their registration papers until full payment is received.
Defaulters – Any purchaser failing to settle as required shall be deemed a defaulter. Horses may be resold at purchaser’s risk and expense, with purchaser liable for deficiencies, late charges (2% per month, compounded), and costs including legal fees.
FIFTH – LIMITATION OF WARRANTIES
Other than expressly stated warranties herein, no guarantee is made as to the soundness, condition, wind, or other quality of any horse.
Exceptions (must be announced at time of sale):
Eye defects
“Cribbers”
“Wobblers”
Failure to announce these conditions makes the horse returnable to consignor within 48 hours with proper veterinary certification.
Incorrect descriptions regarding colt/gelding/ridgling status are also returnable under the same 48-hour rule.
SIXTH – RESOLUTION OF DISPUTES; HOLD CTHS HARMLESS
Other than disputes subject to binding arbitration, disputes among consignor, buyer, and/or CTHS may be resolved judicially, with costs, expenses, and interest recoverable by CTHS.
If no party takes possession of a disputed horse, CTHS may care for or resell the horse at its discretion, with costs recoverable from the ultimate owner.
SEVENTH – REGISTRATION CERTIFICATES
The Registration Certificate must be furnished by consignor. Settlement will be withheld until all papers are delivered to CTHS. Registration papers may also be withheld until consignor’s/purchaser’s accounts are paid in full.
EIGHTH – CATALOGUE PAGES
Accuracy of catalogue information is the sole responsibility of the consignor. Consignors must review their catalogue pages and report inaccuracies prior to sale. Stakes engagements, pregnancy status, and other representations are consignor’s responsibility.
Purchaser’s sole remedy for inaccuracies against CTHS is a refund of purchase price upon return of the horse.
NINTH – RIGHT OF EXCLUSION/BID REFUSAL
CTHS reserves its right to exclude any person from the auction area and to refuse bids from any person, regardless of credit approval. Such exclusion shall not be made on the basis of race, sex, color, or creed.
TENTH – AGENTS
Agents must file notarized letters of authorization from principals. Failure to do so makes the agent personally liable. CTHS may, at its discretion, accept non-notarized authorizations, but this does not relieve agent liability.
ELEVENTH – LIMITATIONS OF ACTION
Any cause of action arising from purchase/sale of a horse must be commenced within one year after the sale (except actions to recover purchase price plus expenses).
TWELFTH – GOVERNING LAWS; VENUE AND JURISDICTION; WAIVER OF JURY TRIAL
The laws of the Province of Alberta govern these Conditions of Sale. All actions shall be brought in a court in Alberta.
Both consignor and purchaser voluntarily and intentionally waive trial by jury.
THIRTEENTH – DISCLAIMER OF IMPLIED DUTIES
CTHS’s duties are limited strictly to those expressly stated herein. Fiduciary or implied duties are expressly disclaimed, except that CTHS must exercise the standard of care generally exercised by comparable horse auction companies.
FOURTEENTH – MERGER OF AGREEMENT
All oral statements or advertisements regarding horses do not constitute warranties and shall not be relied upon.
The entire agreement is contained in these Conditions of Sale and the Acknowledgement of Purchase. Any modifications must be in writing between consignor and purchaser and cannot alter CTHS’s duties.
